1. INTRODUCTION AND ACCEPTANCE
1.1 Agreement to Terms
These Terms of Service ("Terms") constitute a legally binding agreement between you ("User", "you", or "your") and [COMPANY LEGAL NAME], a company registered in [JURISDICTION] with company number [NUMBER] ("Timeless", "Company", "we", "us", or "our").
By accessing or using the Timeless platform, website, mobile applications, or any related services (collectively, the "Service"), you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you must not access or use the Service.
1.2 Eligibility
You must be at least 18 years of age to use the Service. By using the Service, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into these Terms.
1.3 Changes to Terms
We reserve the right to modify these Terms at any time. We will provide notice of material changes by posting the updated Terms on our website and updating the "Last Updated" date. Your continued use of the Service after such changes constitutes acceptance of the modified Terms. If you do not agree to the modified Terms, you must discontinue use of the Service.
2. DESCRIPTION OF SERVICE
2.1 Overview
Timeless is a digital legacy platform that enables users to:
- Create and maintain a personal legacy page ("Legacy Page") containing biographical information, photographs, written content, and audio/video messages;
- Store encrypted digital content in a private vault ("Vault");
- Create shared collections ("Spaces") and share access with others through permanent cryptographic keys ("Keys");
- Participate in optional surveys and view aggregated, anonymised analytics ("Your Voice"); and
- Designate conditions under which content becomes accessible or frozen, including upon death or extended inactivity.
2.2 Zero-Knowledge Architecture
The Service employs zero-knowledge encryption for certain features. This means:
- We cannot access your encrypted content. Content stored in your Vault and Spaces is encrypted using keys derived from credentials that only you possess. We do not store these keys and cannot decrypt your content.
- We cannot recover lost keys. If you lose your master password or sharing keys, we cannot recover them or the content they protect. This is a fundamental security feature, not a limitation.
- You are solely responsible for key management. You must securely store your master password and any sharing keys you generate. Loss of these credentials results in permanent, irreversible loss of access to the associated content.
2.3 Permanent Keys
Keys generated for sharing Spaces are designed to be permanent:
- Keys do not expire automatically;
- Keys remain valid until explicitly revoked by you;
- Once you share a key with another person, they may retain that key indefinitely;
- Revoking a key prevents future access but does not delete content already downloaded by key holders.
3. ACCOUNT REGISTRATION AND SECURITY
3.1 Account Creation
To use certain features of the Service, you must create an account. You agree to:
- Provide accurate, current, and complete information during registration;
- Maintain and promptly update your account information;
- Maintain the security and confidentiality of your login credentials;
- Accept responsibility for all activities that occur under your account;
- Notify us immediately of any unauthorised use of your account.
3.2 Master Password
Your master password is used to derive encryption keys for your Vault and other encrypted content. You acknowledge that:
- We do not store your master password;
- We cannot reset or recover your master password;
- Loss of your master password results in permanent loss of access to encrypted content;
- You are solely responsible for maintaining secure backups of your master password.
3.3 Account Termination by User
You may terminate your account at any time through your account settings. Upon termination:
- Your Legacy Page will be removed from public access;
- Your Vault content will be scheduled for deletion;
- Keys you have generated will be revoked;
- Survey responses will be retained in anonymised, aggregated form;
- Some data may be retained as required by law or for legitimate business purposes.
3.4 Account Termination by Timeless
We reserve the right to suspend or terminate your account if:
- You breach these Terms;
- Your use of the Service poses a security risk;
- Your account is used for illegal activities;
- Required by law or court order;
- We discontinue the Service (see Section 12).
4. LEGACY PAGE AND MEMORIAL FEATURES
4.1 Legacy Page Content
Your Legacy Page is a public-facing page that may include:
- Your name, dates, and biographical information;
- Photographs and written content;
- Audio and video messages;
- A self-authored epitaph or summary.
You are solely responsible for the content of your Legacy Page.
4.2 Storage Limitations
Legacy Pages are subject to a storage limit (currently 24 megabytes). This limit:
- Is a design feature intended to encourage curation;
- May be adjusted for different subscription tiers;
- Encompasses all content on your Legacy Page including media files.
4.3 Public Visibility
Your Legacy Page is publicly accessible by default. You acknowledge that:
- Anyone with your Legacy Page URL can view its contents;
- Legacy Pages may be indexed by search engines;
- You should not include content you do not wish to be publicly visible.
4.4 Memorial Freeze
Your Legacy Page may become permanently frozen ("Memorial Freeze") under the following conditions:
- Manual Activation: You explicitly mark your Legacy Page as complete;
- Inactivity Trigger: You fail to confirm continued activity within the period you specify (the "Inactivity Period"), and designated contacts confirm the trigger condition;
- Death Verification: Designated contacts confirm your death through our verification process.
Once frozen:
- The Legacy Page cannot be edited by anyone, including Timeless;
- A cryptographic timestamp is recorded to prove the content existed at that time;
- The freeze is permanent and irreversible;
- We commit to preserving the frozen page in perpetuity (subject to Section 12).
4.5 Inactivity Period and Dead Man's Switch
You may configure an Inactivity Period after which your account enters a review state. You acknowledge that:
- You are responsible for responding to activity confirmation requests;
- Failure to respond may result in notifications to your designated contacts;
- Confirmation by designated contacts may trigger the Memorial Freeze;
- You should keep your contact information and designated contacts current;
- We are not liable for freezes triggered by your failure to respond to confirmation requests.
4.6 Designated Contacts
You may designate trusted contacts who can:
- Receive notifications if you fail to confirm activity;
- Confirm or deny that a freeze condition has been met;
- Access Spaces you have designated for them.
You are responsible for:
- Selecting trustworthy individuals as designated contacts;
- Keeping designated contact information current;
- Informing designated contacts of their role and responsibilities.
5. VAULT AND SPACES
5.1 Vault Storage
Your Vault is private encrypted storage for digital content. You acknowledge that:
- Vault content is encrypted with keys derived from your master password;
- We cannot access, view, or recover Vault content;
- Storage limits apply based on your subscription tier;
- You are responsible for maintaining backups of important content.
5.2 Spaces
Spaces are curated collections of Vault content that you can share with others. You acknowledge that:
- Creating a Space does not duplicate content; it references your Vault items;
- Deleting content from your Vault removes it from all Spaces containing that content;
- You control who can access each Space through Keys you generate.
5.3 Key Generation and Sharing
When you generate a Key for a Space:
- The Key is permanent and does not expire;
- Anyone with the Key can access the Space (until you revoke the Key);
- We display the Key once; you must save it securely;
- We store the Key encrypted with your master password so you can retrieve it;
- We cannot recover Keys you have lost or failed to save.
5.4 Key Revocation
You may revoke any Key at any time. Revocation:
- Prevents future access using that Key;
- Takes effect immediately;
- Does not delete content already accessed or downloaded by Key holders;
- Does not notify Key holders that access has been revoked;
- Is irreversible — a revoked Key cannot be reinstated.
5.5 Recipient Responsibilities
If you access a Space using a Key:
- You may view and download content as permitted by the Space owner;
- You must not share the Key without permission from the Space owner;
- You must not attempt to circumvent access controls;
- Your access may be revoked at any time without notice;
- Content may be removed or modified by the Space owner at any time.
6. YOUR VOICE (SURVEYS AND ANALYTICS)
6.1 Survey Participation
You may optionally participate in surveys about your views, experiences, and demographics ("Your Voice"). Participation is voluntary.
6.2 Data Usage
Survey responses are used to:
- Show you how your views compare to others;
- Generate aggregated, anonymised statistics;
- Create public reports on trends and demographics;
- Support historical and research purposes.
6.3 Anonymisation
Aggregated data is anonymised such that:
- No individual can be identified from published statistics;
- Demographic combinations with insufficient respondents are suppressed;
- Your individual responses are never publicly displayed.
6.4 Data Retention
Survey data is retained as follows:
- Your individual responses: accessible to you while your account is active;
- Anonymised aggregates: retained indefinitely for historical purposes;
- After account deletion: individual responses are anonymised and merged into aggregates.
6.5 Research and Third-Party Access
Anonymised, aggregated data may be:
- Published in reports and analyses;
- Shared with academic researchers;
- Used for historical and demographic research;
- Licensed to third parties in aggregate form only.
Individual responses are never sold or shared in identifiable form.
7. USER CONTENT AND CONDUCT
7.1 Your Content
You retain ownership of all content you upload to the Service ("User Content"). By uploading User Content, you grant Timeless a limited licence to store and process your content to provide the Service.

- You own or have the necessary rights to the content;
- The content does not infringe any third party's intellectual property rights;

- Constitutes harassment, threats, or incitement to violence;
- Contains malware, viruses, or malicious code;
- Infringes intellectual property rights;
- Violates privacy rights without consent;
- Is fraudulent or deceptive.
7.4 Content Moderation
Due to our zero-knowledge architecture:
- We cannot proactively monitor encrypted content;
- We rely on reports from users and Key holders;
- We may investigate reported content where technically possible;
- We may terminate accounts where prohibited content is confirmed;
- We may report illegal content to law enforcement as required by law.
7.5 Prohibited Conduct
You must not:
- Use the Service for any illegal purpose;
- Attempt to gain unauthorised access to accounts, systems, or data;

8.5 Lifetime Subscriptions
If you purchase a lifetime subscription:
- You receive the specified features for as long as the Service operates;
- "Lifetime" means the lifetime of the Service, not your biological lifetime;
- No refunds are provided for lifetime subscriptions except as required by law;
- Features may change over time, but core functionality will be maintained.
9. INTELLECTUAL PROPERTY
9.1 Timeless Property
The Service, including its software, design, trademarks, and documentation, is owned by Timeless and protected by intellectual property laws. These Terms do not grant you any rights to our intellectual property except the limited licence to use the Service.
